1. Introduction

Welcome to Kesem (Crossword Puzzles). These Terms of Service apply to the use of the app, website, and related services. By using the service, you agree to these terms.

2. User-Generated Content

2.1 Ownership

Content you create (crosswords, clues, display names, etc.) belongs to you. By publishing or sharing content on the service, you grant Kesem a non-exclusive, worldwide, royalty-free license to display, store, distribute and share it as part of the service.

2.2 Creator Responsibility

You are solely responsible for the content you create, share or publish. Kesem is not responsible for user-generated content.

2.3 AI-Written Clues

Clues generated with artificial intelligence are written automatically and may be wrong, inaccurate or unsuitable. It is your responsibility to review them before sharing a crossword, and Kesem is not responsible for their content.

3. Acceptable Use

When using the service, you agree not to:

• Publish offensive, threatening, racist, harassing, sexual or illegal content, including in display names and in crosswords you create
• Impersonate another person or entity, or use a misleading display name
• Share links, contact details or other people's personal information, or try to get users to hand over information or money (phishing and fraud)
• Use the service for spam or unauthorized advertising
• Harass other users
• Cheat in games, use bots, scripts or automation, or exploit bugs in the service
• Copy, reproduce, reverse-engineer or automatically collect content or data from the service
• Sell, rent or transfer an account or subscription to someone else
• Make fraudulent purchases, or wrongfully reverse charges after receiving access to paid features
• Attempt to damage the service, its infrastructure or its security

4. Multiplayer

In multiplayer games, your display name, score and solved words are visible to the other players in the room. The player who opens a room (the host) may remove players from it. Kesem may close rooms, remove players and change offensive display names, and rooms are deleted automatically some time after a game ends.

5. Premium Subscription and Payments

• Some features are available only with a Premium subscription. Purchases and billing are handled by your App Store or Google Play account, under their terms and policies.
• The subscription renews automatically at the end of each period at the price shown to you, unless cancelled at least 24 hours before the end of the period. You manage and cancel auto-renewal in your store account settings.
• After cancellation, Premium features remain available until the end of the paid period. Cancelling mid-period does not entitle you to a refund for the remaining time, unless the law requires otherwise.
• Refund requests are handled by Apple or Google under their policies. Kesem does not charge or refund payments itself.
• Kesem may change the subscription price with advance notice and in line with store rules. A price change does not apply to a period already paid for.
• Kesem may add, change or remove features in Premium and in the free version, and may change the limits of the free version.

6. Enforcement, Suspension and Content Removal

Kesem reserves the right, at its sole discretion and without prior notice, to remove any content, close rooms, restrict or suspend access and delete accounts, especially in case of a breach of these terms, suspected fraud or cheating, or a wrongful chargeback. In such cases, to the extent the law permits, no subscription refund will be given.

7. Changes to the Service

Kesem may change, suspend or discontinue the service or any part of it at any time, including multiplayer, daily crosswords and AI clue writing. We do not promise that the service will always be available, uninterrupted or error-free.

8. Limitation of Liability

The service is provided "AS IS" and "AS AVAILABLE", without warranty of any kind, express or implied. Kesem shall not be liable for any direct, indirect, consequential or special damages arising from the use of, or inability to use, the service. In any case, Kesem's total liability shall not exceed the amount you paid for the service in the 12 months before the event, to the maximum extent permitted by law.

9. Age Requirement

Use of the service is permitted for ages 13 and above. Users under 13 may use the service with parental or guardian consent. Purchases by minors require the consent of a parent or guardian.

10. Changes to These Terms

Kesem may update these terms from time to time. We will announce material changes in the app or on the website. Continued use of the service after an update constitutes acceptance of the updated terms.

11. Governing Law and Jurisdiction

These terms are governed by the laws of the State of Israel, and the competent courts in Israel have exclusive jurisdiction over any matter relating to them, subject to mandatory provisions of the law that applies to you.
